K.Nageshwara Sharma v. State Of Telangana And Another
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2497 OF 2018 ORDER:
The petition is filed seeking for modification of the order passed by the VIII Additional Sessions Judge, Ranga Reddy Dirstirct, L.B.Nagar, in Crl.M.P.No.30 of 2018 in Crl.A.No.158 of 2018, dated 20.02.2018, wherein a direction was given to the petitioner to deposit Rs.7,00,0000/- on or before 09.03.2018. 2.
The counsel for the petitioner submits that there is ample opportunity for him to succeed in the appeal. But, the counsel for the 2nd respondent relies on the said judgment, wherein, it was observed that all the transactions were admitted to have been made online and the accused admitted that the amounts were transferred to his account.
3.
Hence, in view of the above, this Court finds that the contention of the petitioner's counsel that he has ample opportunity to succeed in the appeal is not well founded. 4.
Hence, in view of the above, this Court is not inclined to interfere with the said order. Hence, the criminal petition is dismissed. However, at the request of the counsel for the petitioner, four weeks time is granted for depositing Rs.7,00,000/-, i.e., on or before 04.04.2018.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
