THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38029 OF 2016 ORDER:

The present Writ Petition came to be filed with the following prayer:

"... to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the Respondent No.2 to 4 on petitioner's representation dt. 14-09-2016 against the illegal construction of church and also construction of Ibrahimpatnam Lorry Owners Association by Respondents No. 5 and 6 respectively in petitioner's land admeasuring Ac.0.20 cents in R.S.No.225/3A situated at Ibrahimpatnam Village & Mandal, Krishna District as being illegal, arbitrary and unjust and violative of Principles of Natural justice besides violation of Article 300-A of the Constitution of India and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

2. The grievance of the petitioner is that though the subject land belongs him, respondent Nos.5 and 6 are trying to encroach upon the same and as such, he made a representation on 14.09.2016 to respondent No.3 to take action against the encroachers and to protect the land. But no action is said to have been taken on his representation till date. Hence, seeks a direction to respondent No.3 to consider the representation, dated 14.09.2016, made in this regard.

3. Learned Government Pleader for Revenue submits that if the representation of the petitioner is still pending consideration, respondent No.3 may be directed to consider the same.

4. Having regard to the above submissions and without going into merits of the case, the Writ Petition is disposed of directing respondent No.3 - Tahsildar, Ibrahimpatnam Mandal, Krishna District, to dispose of the representation, dated 14.09.2016, of the petitioner in accordance with law, after hearing all the aggrieved persons, including the petitioner herein, within a period of eight (8) weeks from the date of receipt of a copy of this order.
