THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21289 of 2017 ORDER:

Learned counsel for petitioner, after arguing the writ petition for sometime, does not pursue the prayer, but seeks liberty to avail the remedy of appeal under Section 10 of the A.P.Land Encroachment Act, 1905.

Having regard to the peculiar fact situation of the case and the manner in which the eviction order is being implemented, he requests protection in the meantime.

The Assistant Government Pleader since opposes maintainability of writ petition, on the alternate submission, leaves it to the Court. Having regard to the above submissions, the writ petition is disposed of by this order.

(a) The petitioner is given liberty to file appeal within four weeks from today by enclosing a copy of this order. (b) The parties are directed to maintain status-quo for a period of eight weeks from today and in the meantime, the petitioner can move the appellate authority for staying the operation of eviction order and if such request is made, the appellate authority considers passing orders before expiry of eight weeks period granted by this Court.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
