ORDER:
Heard.
2. Petitioner complains of inaction on the part of the Investigating Officer in completing the investigation with respect to Cr.No.17 of 2014 on the file of the Police Station Burgampahad.
3. The aforesaid crime was registered on 29.01.2014 on the private complaint filed by the petitioner and as per the directions of the learned Magistrate. The complaint of the petitioner is with regard to the accused, who is said to have forcibly and unlawfully closed and filled up the drinking water well dug by the petitioner and four others in the year 1973 adjacent to their house. In spite of the private complaint and the FIR, no progress is made in the investigation, hence the present writ petition is filed.
4. Instructions received by the learned Assistant Government Pleader for Home show that the Investigating Officer examined the complaint and summoned several witnesses and recorded their statements. However, the investigation is pending for recording of statement of cited witnesses and for collection of material evidence.
It is also stated that the investigation would be completed and appropriate report would be filed at the earliest.
5. Since the crime is registered as early as in January 2014, it is imperative that the investigation is completed expeditiously.
6. Learned counsel for the petitioner also states that the petitioner will cooperate with the Investigating Officer and produce such other witnesses or material evidence as is available with him.
7. In view of the above, the third respondent is directed to complete the investigation expeditiously and file an appropriate report/charge sheet before the jurisdictional Magistrate within a period of two (2) months from the date of receipt of a copy of this order.
The writ petition is disposed of. As a sequel, the miscellaneous
