THE HONOURBLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 3639 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) by the petitioner for grant of pre-arrest bail in Crime No.12 of 2025 of EOW Cyberabad Police Station, Cyberabad.

Heard Mr. Y. Soma Srinath Reddy, learned counsel for the petitioner, and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent-State.

The brief facts of the case are that though the de facto complainant invested huge amounts in Falcon Invoice discounting firm, the accused persons failed to repay the invested premature amounts. Hence, a case was registered vide Crime No.12 of 2025 of EOW Cyberabad Police, Cyberabad, for the offences punishable under Sections 318(4), 316(2), 61(2) of the BNS and Section 5 of the Telangana State Protection of Depositors of Financial Establishments Act.

Learned counsel for the petitioner submitted that the petitioner was not made an accused in Crime No.12 of 2025 as on today. However, the police are trying to apprehend the petitioner.

Hence, the petitioner may be enlarged on bail in the event of her arrest.

Per contra, learned Additional Public Prosecutor has not disputed that the petitioner is not an accused in Crime No.12 of 2025. However, during the course of investigation, if the Investigating Officer has come to the conclusion that the petitioner was involved in the crime, they will follow the due procedure as contemplated under the provisions of the BNSS/Code of Criminal Procedure, 1973.

Having considered the submissions made by the respective parties and after perusal of the material available on record, it reveals that as on today, according to the learned Additional Public Prosecutor, the petitioner is not made an accused in Crime No.12 of 2025. Taking into consideration the facts and circumstances of the case, this Court, without expressing any merits of the case, grants pre-arrest bail to the petitioner subject to the following conditions: (i) The petitioner shall be released on bail in the event of arrest on furnishing personal bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with two sureties for a like sum each to the concerned Investigating Officer.

(ii) The petitioner shall abide by the conditions stipulated under Section 482 (2) of the BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
