HON'BLE SRI JUSTICE S.V. BHATT W.P. No.20074 OF 2011 ORDER:

The petitioners pray for re-conveyance of land acquired through Award No.8/ 80 dated 14.07.1980 covering Survey Nos.204, 205, 206 and 212 of Laxmipuram Village, Kanithi Gram Panchayat, Gajuwaka Mandal, Visakhapatnam.

The petitioners rely upon a precedent wherein the respondents claimed to have re-conveyed land after receiving compensation amount. Be that as it may, in the case on hand, respondents filed counter affidavit and they stated in clear and categorical terms, firstly that the parents of the petitioners have received compensation amount for acquiring the land in Survey numbers referred to above and the possession of land is with Visakhapatnam Steel Plant. The request of re-conveyance cannot and could not be considered having regard to the option available to respondents in Paragraph 32 of Board Standing Order 90 and also the view taken by Hon'ble Supreme Court in Government of A.P. v. Syed Akbar1.

Mr.Laxma Reddy having regard to the stand taken in the counter affidavit could not convince the Court to independently consider and grant any relief to petitioners. The writ petition fails and is dismissed. No order as to costs.
