Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 20.02.2015, as illegal and arbitrary. Petitioner is the dealer of fair price shop No.27, Korrakodu Village, Kuderu Mandal, Anantapur District. Based on the report submitted by the 4th respondent alleging certain irregularities, the 3rd respondent issued show cause to the petitioner, for which, he submitted his explanation. Thereafter, the 3rd respondent vide proceedings dated 20.2.2015 suspended the authorization of the petitioner.
Learned counsel appearing for the petitioner submits that the alleged irregularities relate to July, 2014 and the suspension order is prompted by mala fides.
In any event, the petitioner preferred an appeal, which is now pending before the 2nd respondent.
Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 2nd respondent-Joint Collector, Anantapur, to dispose of the appeal within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
