THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6743 of 2018 ORDER:
In this Writ Petition, petitioner challenges the notice, dated 15.02.2018, whereunder the third respondent - Avilala Gram Panchayat, represented by its Secretary, Avilala, Tirupati Rural Mandal, Chittoor District, intimated her that the inspection made by him revealed that she is making construction in violation of the sanctioned plan.
The petitioner asserts in the writ affidavit that she had not made any construction in violation of the sanctioned plan and submitted her objections to the impugned notice. Heard learned counsel for the petitioner and learned Standing Counsel for the third respondent.
A perusal of the impugned notice does not indicate in what way, the petitioner violated the sanctioned plan. Inasmuch as the impugned notice is vague, no further action shall be taken by the third respondent pursuant thereto.
CKR, J W.P.No.6743 of 2018 In those circumstances, this Court disposes of the Writ Petition directing the third respondent to cause fresh enquiry into the matter and if he finds any deviation made by the petitioner in making construction, he shall issue notice to the petitioner specifying the nature of such deviation, give her an opportunity to submit her explanation and proceed further by taking action in accordance with law.
Miscellaneous Petitions, if any pending shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 5th MARCH, 2018.
