This writ petition is filed seeking to issue a writ of mandamus, declaring the inaction of the respondents in finalizing the land acquisition proceedings which were initiated by respondent No.2 even after taking possession of the land from the landowners and in handing over the possession to the beneficiaries as per the list prepared by the then Mandal Revenue Officer, Santhipuram, dated 10.01.1992, as arbitrary, illegal, violative of Article 21 of the Constitution of India and contrary to the Order 21 of the Board Standing Orders, and consequently to direct the respondents to finalize the land acquisition proceedings and allot the house sites to the beneficiaries, as per the list prepared by the then Mandal Revenue Officer, Santhipuram Mandal, Chittoor District, dated 10.01.1992.

Heard Sri M.Venkata Ramana Reddy, learned counsel for the petitioners and the learned Government Pleader for Land Acquisition. When the matter is taken up for hearing today, the learned Government Pleader for Land Acquisition has submitted that as per the latest instructions given by respondent No.4-the Tahsildar, the respondents have acquired alternative land for the purpose of distribution to the landless poor, and the house sites were also distributed to the beneficiaries, as per the beneficiaries list prepared by the Mandal Revenue Officer, Santhipuram, wherein the petitioners herein were also allotted house sites.

AKS,J WP_25404_2007 In view of the above submission made by the learned Government Pleader, the cause in this writ petition does not survive. Accordingly, the writ petition is closed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
