HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU I.A.No.4 of 2018 And Second Appeal No.687 of 2013 JUDGMENT:

All the petitioners/appellants and the respondent/ plaintiff in the compromise application viz., I.A.No.4 of 2018 are present before this Court.

They state that the compromise has been entered voluntarily and with their consent only. The receipt of the Demand Draft for Rs.3,00,000/- (Rupees Three Lakhs only) acknowledged by the respondent/plaintiff. The identity of the parties is proven by the Photostat copies of their aadhaar cards, which are filed and countersigned by the learned counsel for the petitioners and the respondent.

In that view of the matter, the compromise is recorded. I.A.No.4 of 2018 is accordingly allowed. In view of the compromise recorded, the judgment and decree dated 29.06.2009 passed in OS No.48 of 2001 by the Junior Civil Judge, Mahabubabad, as confirmed by the VI Additional District Judge (III FTC), Warangal at Mahabubabad in AS No.30 of 2010 is affirmed. Hence, the suit is decreed as prayed for. The terms of the compromise shall form a part of the judgment and decree whenever the same is applied and supplied to the parties.

Accordingly, the second appeal is closed as compromised. In the circumstances of the case, there shall be no order as to costs.

Miscellaneous Petitions, if any pending in this appeal shall stand closed.
