ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.
The Petitioner' grievance is that he is the owner and possessor of agricultural land admeasuring Ac.2.13 cents in survey No.456/1 of Kamavarapukota Revenue Village and Mandal, West Godavari District; and that he intended to sell the said land to some third party; but the second respondent is not
receiving the document for the purpose of registration on the ground that the subject property is covered by list of prohibited lands covered by Section 22-A of the Registration Act. The Government Pleader for Revenue appearing for respondents states that the second respondent would receive the document presented by the petitioner and if he does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document. In view of the said submission, the Writ Petition is disposed of directing the second respondent to receive the document as and when presented by the petitioner, and process the same for registration, if it otherwise in order and fulfills the requirements of Stamps and Registration Act.
In case if the second respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks from the date of the document presented by the petitioner and communicate his decision thereon to the petitioner. There shall be no order as to costs.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
