THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23629 OF 2004 ORDER:

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and the petitioner filed this writ petition seeking absorption into aided service. Learned counsel for the petitioner further contended that appointment of the petitioner as Hindi Pandit, Grade-II, was approved in an unaided post by competent authority by proceedings dated 24-08-1991 but the grievance of the petitioner is that a regular aided vacancy arose in respondent No. 4-school with effect from 01-11-1999 and the case of the petitioner was not considered for absorption into aided service and the same was rejected vide orders dated 03-09-2004. Challenging the same, the present writ petition is filed.

Learned counsel for the petitioner submits that as the petitioner now retired from service, appropriate orders be passed directing the respondents to absorb the post of the petitioner in aided service with effect from 01-11-1999 and to that effect, learned counsel submits that let the petitioner be permitted to submit a representation to the respondents seeking absorption into aided service with effect from 01-11-1999 and let the respondents be directed to consider it and pass appropriate orders. Learned Government Pleader submits that appropriate orders would be passed on the representation submitted by the petitioner. 3.

This Court having considered the above said submission made by both learned counsel is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation seeking absorption into aided service with

effect from 01-11-1999 and upon such representation being received, the respondents shall consider it by duly taking into account G.O.Ms.No. 32 dated 25-01-1999 and pass appropriate orders in accordance with law within four weeks from the date of receipt of such representation.

With these observations, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
