Praveen Kumar) This appeal is preferred by the petitioner-husband against the order dated 13.04.2004, passed in O.P.No.33 of 2002, wherein the petition filed by the wife seeking dissolution of the marriage was allowed.

Heard both sides.

Sri Prabhakar Sri Pada, representing learned counsel for the respondent, submits that both wife and husband have compromised the matter and are living together. He also stated across the Bar that the appeal can be allowed. The same is not disputed by the learned counsel for the petitioner.

Having regard to the representation made and in view of the fact that both of them are living together, the appeal is allowed setting aside the order passed by the trial Court in O.P.No.33 of 2002.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
