Heard Sri Siva Sai Swaroop for petitioner and Mrs.Padmavathi for respondents.
The judgment debtor challenges order dated 27-07-2016 in E.P.No.124 of 2016 in the instant civil revision petition. The Executing Court, having regard to the circumstances and necessity to continue to freeze the account, allowed the application. Learned Counsel submits that the ex-parte decree is executed by filing E.P.No.124 of 2016. The petitioner has filed I.A. to set aside the ex-parte decree. He requests the Court to direct the learned trial Judge to pass orders in I.A. within reasonable time. I have taken note of limited submission and to expedite the process of hearing in the suit or the E.P., I deem it appropriate to direct the trial court to dispose of I.A. filed for setting aside the ex-parte decree, within four weeks from the date of receipt of a copy of this order. The petitioner is given liberty to place the order before the trial court along with a Memo for due compliance. With the above observation, the Civil Revision Petition is dismissed. No order as to costs.
