THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6693 of 2018 Order:

In spite of granting ten days time on 28.02.2018, learned Government Pleader could not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition on the basis of the averments made in the affidavit filed in support of the Writ Petition.

The petitioners state that pursuant to their application, each of the petitioners was allotted house site admeasuring 0.01 cent, situated in Survey Nos.51 and 280 of Nunepalli village, Nandyal Mandal, Kurnool District, by proceedings of the third respondent dated 05.05.2008. They have been in possession of the same. While so, when the fourth respondent tried to interfere with the same in the month of February 2018, they filed the present Writ Petition.

Since the petitioners claim to be in possession of the land allotted to them by proceedings dated 05.05.2008, the land of the petitioners shall not be interfered with without following due process of law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
