2. Petitioner and three others are the owners of Plot No.14 in survey No.5 of Tadipatri Village and Mandal. Petitioner intends to sell his share in the said property. But, the second respondent stated to have refused to accept the same on the ground that the property in survey No.5 of Tadipatri Village and Mandal is a Government land. Petitioner also relied upon the information furnished under Right to Information Act by the 2nd respondent with respect to the same.
3. Apparently, petitioner has not presented the document, in question, and without presentation of the said document, the contention of the petitioner is premature. The Sub-Registrar, Tadipatri is yet to receive the document presented by the petitioner.
4. Hence, the Writ Petition is disposed of granting liberty to the petitioner to present the document before the second respondent. Thereafter, the second respondent shall examine the document so presented by the petitioner and if it is found to be in conformity with the requirements of the Indian Stamp Act and the Registration Act and the Rules thereunder, register the same or otherwise pass appropriate order on the touchstone of law governing the field. However, if the document presented by the petitioner warrants denial and cannot be admitted to registration, the reasons for such refusal shall be communicated to the petitioner.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
