THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2085 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.1 in the event of his arrest in connection with Crime No.34 of 2022 on the file of Station House Officer, Mattampalli Police Station, Suryapet District registered for the offence punishable under Section 307 read with Section 34 of Indian Penal Code (I.P.C.) 2.
Heard the learned counsel for the petitioner/Accused No.1 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Petitioner is arrayed as Accused No.1 in the aforementioned Crime registered for the offence under Section 307 of IPC. 4.
The facts of the case are that on 10.02.2022 at about 09.30 PM when the husband of the de facto complainant went to Anganwadi School and while observing the construction material, Accused No.2 forcibly caught hold the husband of the de facto
complainant and petitioner/Accused No.1 stabbed on his stomach, as a result, he received severe injury.

Learned Assistant Public Prosecutor submits that the investigation is almost complete.

The interim order granted on 21.03.2022, which was again extended on 31.03.2022.

In the said circumstances, when there is no requirement of custodial interrogation of the petitioner/Accused No.1, he can be granted the relief of Anticipatory Bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted bail subject to the following conditions:
i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Mattampalli Police Station, Suryapet District, within a period of fifteen (15) days from today, and on such surrender, the said Station House Officer shall release the petitioner/Accused No.1 on bail on his executing a personal bond for
a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties to the like sum each to his satisfaction.
ii) The petitioner/Accused shall appear before the investigating authorities as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
