K. Satyanarayana Rao, v. State Of Andhra Pradesh
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13355 OF 2017 ORDER:
This writ petition is filed challenging the show cause notice dated 17.03.2017 issued by the 2nd respondent. Learned counsel for the petitioner submits that the Public Information Officer without passing orders under Section 11(2) of the Right to Information Act, 2005, straight away passed orders dated 01.03.2017, and basing on the same, present show cause notice dated 17.03.2017 is issued which is erroneous.
When this Court was not inclined to interfere with the show cause notice, learned counsel for the petitioner submitted that the petitioner will raise all his objections before the 2nd respondent and the 2nd respondent may be directed to consider the same.
Normally, this Court will not interfere with the show cause notice. In view of the submission of the learned counsel for the petitioner, it is open for the petitioner to raise all his objections before the 2nd respondent, and on submission of objections by the petitioner, the 2nd respondent shall consider the same and pass orders, in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 25.04.2017 Note: Issue CC in three days.
