Learned counsel for the petitioner submits that since the contract period is for ninety days, this writ petition has become infructuous. He further submits that he submitted a representation for return of Earnest Money Deposit (EMD) and the EMD is not returned.

In the above circumstances, it is open to the petitioner to challenge the said action in appropriate proceedings. In the result, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
