THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34979 OF 2015 ORDER:

The prayer in this writ petition is to call for the records relating to Crime No.653 of 2015 on the file of Miyapur Police Station, Cyberabad Commissionerate, and quash the same insofar as the petitioner is concerned. The petitioner is arrayed as accused No.1 in the said crime.

The Inspector of Police, Miyapur Police Station, Cyberabad, filed a counteraffidavit stating that the investigation in the subject crime is still at the preliminary stage and it cannot be stated with certainty at this stage as to whether the petitioner has anything to do with the commission of the offence. The Inspector further stated that depending upon the evidence adduced during the course of the investigation, necessary action would be taken against the concerned accused and an appropriate report under Section 173 Cr.P.C. would be filed before the competent court by following the due procedure.

In the light of the afore-stated averments made by the Inspector of Police, the writ petition is closed leaving it open to the police authorities to act strictly in accordance with the due procedure while investigating the subject crime and taking appropriate action in the matter thereafter. Needless to state, the petitioner shall cooperate with the investigation. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
