HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CIVIL REVISION PETITION No.1384 of 2016 ORDER :

This revision petition is filed by the petitioners/respondents/ defendants under Article 227 of the Constitution of India, aggrieved by the ex parte interim injunction granted by learned SubDivisional Magistrate, Mobile Court, Bhadrachalam in I.A.No.12 of 2016 in O.S.No.15 of 2016.

Notice given to respondent/petitioner/plaintiff. Heard both sides.

During the course of hearing, both parties agreed that the present petitioners/respondents/defendants would file counter in I.A.No.12 of 2016 in O.S.No.15 of 2016 and argue the matter before the trial Court and they pray to give a direction to the trial Court to dispose of I.A.No.12 of 2016 within a specific time. In the light of above submission of both sides, the Civil Revision Petition is disposed of with a direction to the present petitioners/ respondents/defendants to appear before the lower Court and file their counter in I.A.No.12 of 2016 in O.S.No.15 of 2016 within two weeks from the date of this order, in which case, the learned trial Court shall dispose of I.A.No.12 of 2016 in O.S.No.15 of 2016 on merits within four weeks from the date of filing of counter by the petitioners herein. Till disposal of I.A.No.12 of 2016 by the trial Court, status quo as on today shall be maintained in respect of suit property.

Civil Revision Petition is disposed of accordingly. No costs. Pending miscellaneous applications, if any, shall stand closed.
