ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in seeking to interfere with the sale and marketing of the petitioner's products, which are claimed to be bio-products, as illegal and arbitrary.

At the hearing, Sri P.Mohith Reddy, learned counsel representing Sri S.Niranjan Reddy, learned counsel for the petitioner, submitted that in pursuance of order, dated 10.12.2007, in Writ Petition No.26027 of 2007, the respondents have tested the samples of the petitioner's products and allegedly found that the same contain chemical and pesticide contents and that challenging the test reports, the petitioner has filed a separate Writ Petition, viz., Writ Petition No.36313 of 2013 which is pending in this Court.

In my opinion, in view of the above-mentioned subsequent events, the necessity of adjudicating the present Writ Petition is obviated. The petitioner is entitled to pursue the subsequent Writ Petition, viz., W.P.No.36313 of 2013, which is stated to be pending in this Court.

Subject to this liberty given to the petitioner, the Writ Petition is disposed of.

As a sequel to the disposal of the Writ Petition, interim order, dated 09.12.2011, in WPMP.No.40232 of 2011 is vacated and WPMP.No.40232 of 2011 is disposed of as infructuous.
