HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8569 of 2015 ORDER :

This criminal petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in S.C.No.239 of 2015 on the file of II Additional Metropolitan Sessions Judge, Hyderabad, for the offences punishable under Sections 498-A and 306 IPC.

2. Heard the learned counsel for the petitioner and the 2nd respondent-State represented by the Public Prosecutor, before admission and before notice to the 1st respondent and perused the material on record.

3. The above sessions case is an out come of the report of the de facto complainant, who is mother-in-law of petitioner/accused, for the unnatural death of the daughter of the de facto complainant and wife of the petitioner by hanging within four walls. Today, the petitioner, de facto complainant and two daughter of the petitioner are present. The two daughters stated that their father is looking after them and the death of their mother is not due to any acts of their father.

Whereas the de facto complainant stated that the petitioner did not marry after the death of her daughter and the petitioner is not responsible for the unnatural death of her daughter and the report was given under a heat of fashion.

4. Having regard to the above, this criminal petition is allowed and all the proceedings relating to S.C.No.239 of 2015 on the file of II Additional Metropolitan Sessions Judge, Hyderabad, are quashed against the petitioner/accused. The bail bonds of the petitioner/accused, if any, shall stand cancelled.

5. Miscellaneous petitions pending, if any, shall stand closed.
