HON'BLE SRI JUSTICE S.V.BHATT W.P.No.33096 OF 2013 ORDER:

The petitioner prays for the following relief: "...this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus - declaring the inaction of the respondent no 3 in conducting properly the investigation in Crime No.315/2013 on the file of 4th Town PS Nizamabad as he failed to seize the passport of Sravan Kumar the accused No.2 in the crime and to register the crime under appropriate sections and that the inaction of the 1st respondent in not initiating legal action against the accused under proper sections in-spite of sending detailed complaint Dt.15.11.

2013 as illegal and against the procedure mandated under the Code and Statutory functions cast on them and consequently, direct the 1st respondent to see that investigation is done properly by adding appropriate sections in the above Crime and that measures are taken to see that the 2nd accused namely Sravan Kumar does not leave the country by seizing his passport and also to see that protection is provided to the family and house property of the Writ Petitioner in the interest of justice and to pass....." The Assistant Government Pleader, on instructions, submits that investigation is completed and charge sheet is also filed. In view of the subsequent developments, no further order is necessary. The writ petition is, accordingly, dismissed. There shall no order as to costs.
