THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6702 of 2018 O R D E R :

This Writ Petition is filed alleging that Respondents 2 to 5 have been trying to dispossess the petitioner by digging the canal through his lands over an extent of Acs.2.00 in Survey No. 120/AA2, an extent of Ac.0.20 guntas in Survey No.119/A1, an extent of Ac.0.20 guntas in Survey No. 119/A2 and an extent of Acs.2.00 in Survey No. 117/A1, total Acs.5.00 situated at Koduparthy Village Shivaru, Thimmajipet Mandal, Nagarkurnool District without following due process of law and without paying any compensation.

Heard learned counsel for the petitioner.

Learned Government Pleader for Land Acquisition (Telangana) has placed on record brief notes submitted by the 3rd respondent Revenue Divisional Officer-cum-Land Acquisition Officer, Nagarkurnool and submits that the land acquisition proceedings were, in fact, initiated in 2016 and notice under Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013 also came to be published on 09.05.2017 and as on date, it is at the stage of award enquiry.

Considering the submission made by the learned Government Pleader and also considering the fact that the Award inquiry has not yet been conducted, the Land Acquisition Officer is directed to issue notice to the petitioner to participate in the Award enquiry, whereat, he shall be entitled to submit his objections / claim with respect to the compensation amount.

Subject to the above, the Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
