HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44757 of 2016 ORDER:

This writ petition is filed seeking a direction to the 3rd respondent not to call the petitioners to the police station and not to harass them without there being any crime registered against them.

Heard and perused the material available on record. 2nd petitioner is the mother of 1st petitioner and the 4th respondent is the wife of 1st petitioner. The grievance of the petitioners is that there is matrimonial dispute between the 1st petitioner and the 4th respondent and that at the instigation of 4th respondent, the 3rd respondent is calling the petitioners to the police station frequently and making them to sit in the station without there being any crime registered against them. Learned Assistant Government Pleader for Home submitted that the 3rd respondent is not intending to interfere with the disputes between the petitioner and the unofficial respondent.

Considering the facts and circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the 3rd respondent not to harass the petitioners and not to call them to the police station without there being any crime registered. However, this order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioners disclosing cognizable offence.
