THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.20778 OF 2001 ORDER:

Petitioner claims to have worked as Junior Lecturer in Urdu in 'A.M.Sahakarapu Junior Kalasala, Guntur', on consolidated pay till 31.06.1992. Thereafter, the same management started a new Junior College named as 'A.M.Junior College' on 01.07.1992 and absorbed the petitioner in the said College in the same post on a consolidated pay of Rs.600/-, the same was enhanced from time to time and finally he was paid Rs.1,675/- after deducting Provident Fund amount. The case of the petitioner is that the post of lecturer in Urdu is lying vacant since 1999 on account of promotion of incumbent as Principal. The same Management also started 'A.M.Degree College' and 'A.M.Junior College' and the same are running in the same unit. Hence, the common seniority has to be maintained.

As per G.O.Ms.No.127 Education dated 07.06.1993 out of four vacancies of lecturers in Degree College, the first, second and third vacancies in each department should be filled up by promotion channel from among the qualified and eligible junior lecturers of the institution under the same management. Thus, alleging inaction on the part of the respondents in not filling up the post of Lecturer in Urdu and considering the representations of the petitioner for promotion, the present writ petition came to be filed.

While admitting the writ petition on 05.10.2001, this Court in W.P.M.P.No.26197 of 2001 granted an interim direction to the respondents to consider the case of the petitioner for promotion as lecturer on adhoc basis.

In the writ petition, the petitioner seeks a direction to the respondents to fill up the vacancy of lecturer in Urdu in A.M. Degree College, Guntur, as per rules keeping in view the directions issued by this Court in W.P.No.11613 of 1999 and also sought for consideration of his case for promotion as per seniority and eligibility.

Having perused the affidavit, counter and reply affidavit, this Court is of the view that in view of the interim direction passed by this Court on 05.10.2001, no further directions require to be issued in this writ petition.

Accordingly, the Writ Petition is disposed of. Miscellaneous petitions pending in this petition, if any, shall stand closed.
