HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21641 OF 2016 ORDER:

The order under challenge is suspension pending enquiry dated 16.04.2016. The petitioner is authorized dealer of fair price Shop No.6 of Parvathareddigaripalle, H/o Dinnepadu Village, L.R.Palli Mandal, Y.S.R.District since 1975. While so, based on the report submitted by the 5th respondent - Tahsildar, the 3rd respondent issued a show cause notice on 16.04.2016 levelling certain allegations and the 2nd respondent by order, dated 20.05.2016, suspended the authorization of the petitioner. Aggrieved by the same, the petitioner filed the present writ petition.

Heard learned counsel for the petitioner and learned Government Pleader. Learned counsel for the petitioner submitted that without hearing the petitioner and without giving time to file explanation, the impugned order was passed. Hence, the impugned order may be suspended.

In view of the above, the writ petition is disposed of permitting the petitioner to file his explanation within a period of three weeks from the date of receipt of a copy of this order. Thereafter, the respondents are directed to complete the enquiry and pass final orders after considering the explanation submitted by the petitioner within a period of three weeks from the date of receipt of the explanation by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any pending in the writ petition, shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
