Sankranthi Veeraiah, v. The Government Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.12219 OF 2015 Date:01.05.2015 Between:
Sankranthi Veeraiah and others .. Petitioners And The State of Andhra Pradesh, rep., by its Principal Secretary to Industries & Commerce (M.III) Department, Secretariat Of A.P., Govt. Hyderabad and others .. Respondents
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.12219 OF 2015 ORDER:
Heard.
The petitioners claim to be the owners of various extents of land. Their grievance is that Mining Lease is being granted to respondent No.11 covering the patta lands of the petitioners. The petitioners state that a group of villagers, including the petitioners, made representations to the Tahsildar, Dachepalli Mandal, Guntur District, on 15.04.2015, and alleging inaction, the present Writ Petition is filed seeking directions to exclude the patta lands of the petitioners from the Mining Lease and Mining Plan being granted to respondent No.11. The instructions of the learned Government Pleader for Mines and Geology show that one Rythu Committee of Gamalapadu has already filed a representation to the Assistant Director of Mines and Geology to the same effect. However, the Government has not yet granted any Mining Lease to respondent No.
11 in the subject area and the required documents are called for by Memo, dated 16.04.2013. Evidently, there is no lease granted in favour of respondent No.11 as on today. If the petitioners seek any specific relief to the extent of their patta lands, they must make a detailed representation to the concerned authorities. The representation, dated 15.04.2015, referred to in this Writ Petition, as Ex.P2, is very cryptic and it is not known as to whether the petitioners are owners and if so, supporting documents thereof must be annexed to the representation. The petitioners are, therefore, at liberty to make appropriate representation to the concerned authorities, so that their grievance can also be looked into while taking appropriate decision in the matter by official respondents.
As on this day, there is no cause of action to entertain the present Writ Petition.
The Writ Petition is, accordingly, disposed of with the liberty as aforesaid. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
