ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused in Crime No.335 of 2026 before the Medipally

Police Station, Malkajgiri District, registered for the offences punishable under Section 299, 109, 352, 74, 191(2), 191(3) read with 190 of BNS.

The brief facts of the case are that the de facto complainant, who is carrying on goat business at Chengicherla Goat Market on leased land, alleged that due to business rivalry and prior disputes, the accused persons, who are running a similar adjacent business, objected to his operations. On 05.03.2026, a quarrel arose regarding fencing of the land. Subsequently, on 07.03.2026 at about 8:00 AM, the accused allegedly attacked the complainant with sticks and a knife, causing injuries, including a bleeding injury near his ear, and also assaulted his brother and mother when they intervened. Based on the complaint, FIR No.335 of 2026 was registered. A counter case in FIR No.336 of 2026 was also registered on the complaint of the petitioners. 3.

Heard Sri Bharadwaj Associates, appearing on behalf of the petitioners as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent, law-abiding businessmen falsely implicated due to business rivalry and that a case and counter case have been registered, and the complaint in FIR No.335 of 2026 is mala fide and exaggerated. The petitioners have no criminal antecedents, are willing to cooperate with the investigation, and undertake to furnish sureties. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the petition, submitting that the allegations disclose a serious offence involving a planned attack with weapons causing injuries to multiple persons. He further submitted that the investigation is at a crucial stage, witnesses are yet to be examined, and custodial interrogation is necessary. Therefore, at this stage, granting of pre-arrest bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on

record, it appears that the dispute between the parties primarily arises out of business rivalry and prior financial and personal differences between them. The main allegation against the petitioners is that they allegedly attacked the de facto complainant with sticks and a knife, causing injuries to him and his family members. Further, as seen from the record, there are case and counter case registered between the parties in respect of the very same incident. Considering the facts and circumstances of the case, the nature of allegations, and the existence of case and counter case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Medipally Police Station, Medchal-Malkajgiri District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha

Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight

(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

iv.

The petitioners are directed not to contact the de facto complainant or any other witnesses during the course of investigation.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
