HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.45574 of 2016 Order:

This Writ Petition was filed challenging the action of the respondent police in not providing protection to the petitioner and his brothers from the unofficial respondents who are threatening to kill them if they come to Narsaraopet to attend the Negotiable Instruments Act case in spite of the complaint dated 05.08.2016.

Now, a counter affidavit is filed stating as follows. "It is submitted that the fourth respondent herein has nothing to do with the business disputes between the petitioner and the respondents 5 to 8 herein, which lead to filing of complaints under Section 138 of Negotiable Instruments Act cases by the respondents 5 to 8 herein. The contention of the petitioner that the police constables came to the rice mill of the petitioner and forcibly took him to the fourth respondent police station, where the fourth respondent herein abused the petitioner in filthy language and threatened him with dire consequences to settle the disputes with the respondents 5 to 8 herein and obtained five blank cheques and detained the petitioner illegally from 18.06.2014 to 19.06.2014 are all false, baseless, selfserving.

All these allegations in respect of the alleged incident dated 18.06.2014 and 19.06.2014 are made for the first time in the present writ petition in the month of December, 2016. Thus, all such allegations are absolutely false and concocted for the sake of filing this writ petition. It is submitted that it is a fact that the petitioner has sent a representation dated 05.08.2016 to the respondents 2 and 3 herein through registered post, stating that there is danger to him and his family members from respondents 5 and 8 herein at the time of attending Negotiable Instruments Act case at Narsaraopet and requested to provide protection. Accordingly, on receipt of the above representation dated 05.08.

2016 of the petitioner, the respondents 5 and 8 herein were called to the fourth respondent police station and they were bound over in that regard on 28.08.2016 and 30.08.2016 respectively. Thus, there is no inaction on the part of the respondent police authorities, as alleged in the writ petition."

In view of the above statement made by the respondent police, no further orders are necessary in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
