HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION (TR) No.3061 of 2017 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner has contended that the petitioner is going to retire in the month of December, 2019. The respondents have imposed punishment of withholding of two annual grade increments without cumulative effect vide G.O.Rt.No.218 dated 15.10.2014. Since the punishment is without cumulative effect, on expiry of currency of punishment, the petitioner is entitled to get increments. Therefore, appropriate orders be passed in the writ petition directing the respondents to release the increments, which were withheld as a measure of punishment vide G.O.Rt.No.218 dated 15.10.2014, after expiry of currency of punishment.

Learned Government Pleader appearing for the respondents has contended that the respondents have imposed punishment of withholding of two annual grade increments without cumulative effect vide G.O.Rt.No.218 dated 15.10.2014. On expiry of currency of punishment, the petitioner would be entitled to get increments. This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to release the increments, which were withheld as a measure of punishment vide G.O.Rt.No.218 dated 15.10.2014, after

expiry of currency of punishment, before the petitioner retires from service.

With the above observations, the writ petition is disposed of. No order as to costs.
