HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 25308 OF 2011 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Revenue (Andhra Pradesh) and Sri P.Ganga Rami Reddy, learned counsel appearing for respondent No.4. The present Writ Petition came to be filed seeking to direct respondent Nos.1 to 3 to consider the representations dated 19.08.2011, 06.08.2011 and 18.06.2011 made by the petitioner and give a reasonable opportunity to him by furnishing the details of the application made by respondent No.4, before passing any orders under the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971.
Learned counsel for the petitioner also filed additional affidavit, wherein it is stated that pending the Writ Petition, in pursuance of the application filed by the husband of the petitioner under Right to Information Act, respondent No.3 furnished reports of Village Revenue Officer and Mandal Revenue Inspector, who conducted an enquiry pursuant to the application filed by the grand father of respondent No.4 for issuance of pattadar pass books and title deeds. The said reports filed by VRO and MRI are placed on record. Apart from that, the material on record discloses that O.S.No.91 of 2010 on the file of the Senior Civil Judge, Gudur, Nellore District, was filed by the petitioner seeking cancellation of the sale deed to which respondent No.4 claimed title over the property.
In view of the pendency of O.S.No.91 of 2010, filed by the
petitioner herein, seeking cancellation of sale deed and as the records which are sought for by the petitioner were already furnished, no further orders need be passed in this Writ Petition. Accordingly, the Writ Petition is closed. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
