SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2521 OF 2018 ORDER:
This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A3, on bail in Crime No.23 of 2018, on the file of Osmania University Police Station, Hyderabad, for the offences punishable under Sections 341, 302 r/w 34 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, A3 is the husband of A2 and all the accused undertook construction work and when they were stopped by the security guard, from proceeding with the construction work, they had an impression that it was stopped at the behest of the deceased and later, they way laid and killed the deceased. The role of this accused is that he held the deceased, while A1 was hitting the deceased.

Hence, since there are witnesses who came to the spot at the time of the incident and testified about the acts of the petitioner, this Court opines that it is not a fit case for grant of anticipatory bail.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
