HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.6785 of 2018 ORDER:

This Writ Petition is filed the petitioner, under Article 226 of the Constitution of India, seeking the following relief: " .......to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the respondents in not considering the objections of the petitioner filed against the application of the 5th respondent for shifting of the shop from D.No.14-6-3 & 4, Opposite Railway Station, Samarlakota, East Godavari District to D.No.18-1-50/ 5 as illegal, arbitrary and consequently direct the respondents 2 to 4 to consider the objections dated 23.2.2018 before taking decision and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and .........." 2.

Heard learned counsel for the petitioner and learned Government Pleader for Excise appearing for respondent Nos.1 to 4 before ordering notice to respondent No.5 and perused the prayer in the writ petition with supporting affidavit and the so called response of the petitioner to respondent Nos.1 to 4. 3.

Even from perusal of the so called response of the petitioner, it is based on the so called apprehension. It is the submission of the learned Government Pleader that there is no basis to the apprehension of the petitioner and if at all, there is any requirement for any shifting, the respondent-authorities can consider by notice and hearing. Hence, there is nothing to keep the writ petition pending.

Accordingly, this Writ Petition is disposed of. 5.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
