THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2585 OF 2016 ORDER:

This Criminal Petition is filed by the accused 1 & 3 under Section 482 of Cr.P.C. seeking to set aside the docket order dated 14.10.2015 in C.C.No.129 of 2015 passed by the Special Magistrate-II at Rajendranagar, R.R.District whereby the learned Magistrate issued summons to the petitioners for their appearance.

Heard the learned counsel for the petitioners and learned Additional Public Prosecutor. Perused the material on record. Learned counsel for the petitioners submits that the petitioners are presently residing in U.S.A. and that they are ready to face the trial and prayed for recalling of the N.B.Ws. issued against the petitioners.

In the circumstances of the case, the operation of N.B.Ws. issued by the trial Court against the petitioners is hereby suspended for three months from today and within such time, the petitioners are directed to surrender before the trial Court on their arrival from the U.S.A. and file an application seeking to recall the warrant. On filing such application, the Court below is directed to recall the Warrant issued against the petitioners on the same day on execution of a bond by the petitioners for a sum of Rs.1,000/- each with one surety with an undertaking for their further appearance for trial before it.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
