THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.8097 OF 2019 ORDER:

This writ petition is being disposed of at the admission stage with the consent of learned counsel for both parties. This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents in not providing dependent employment to the petitioner in view of the death of his father while working as Electrician in K.K-V Incline, Mandamarri Area, Singareni Collieries Company Limited, in spite of submitting the application within time, even though the petitioner is the only son of the deceased employee, as illegal, arbitrary, abuse of process of law, violation of principles of natural justice and contrary to rules and the circulars issued by the Company from time to time and sought a consequential direction to the respondents to consider the case of the petitioner for providing dependent employment in any suitable post as per his eligibility in view of the death of his father who died while working as Electrician in the respondent company by considering the representation submitted by the petitioner.

Heard Sri S. Surender Reddy, learned counsel for the petitioner, and Sri J. Sreenivasa Rao, learned Standing Counsel for the respondents.

It has been contended by the petitioner that his father, who was employed with the respondent Company as Electrician, expired on 16.08.2016 while discharging his duties. Thereafter, the petitioner has

submitted a representation to the respondents on 17.02.2019 requesting the respondents to consider his case for appointment under dependent employment quota. The petitioner contends that the respondents are neither considering his representation nor considering his case for appointment under dependent employment quota. Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for appointment under dependent employment quota and pass appropriate orders. Learned Standing Counsel appearing for the respondents had contended that the case of the petitioner would be considered and appropriate orders will be passed based on the representation submitted by the petitioner.

This Court, having considered the submissions of the learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 17.02.2019 and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. No order as to costs.
