W.A.No.353 of 2019 HACJ & ARRJ JUDGMENT: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) The appellant has challenged the interim order passed by a learned Single Judge in I.A.No.1 of 2019 in W.P.No.6758 of 2019 dated 29.03.2019, whereby the learned Single Judge has stayed the collection of interest portion from the impugned demand, but has directed the appellant to pay the balance amount of tax in two installments; the first installment to commence from 15.04.2019, and the second installment from one month thereafter.
The learned counsel for the appellant submits that, even according to the first assessment order, the demand was for Rs.16,96,599/-.
However, certainly, it was raised to Rs.18,00,000/-. Therefore, the learned counsel for the appellant submits that only 50% of Rs.16,96,599/- should have been ordered to be deposited by the appellant in favour of the respondents. On the other hand, the learned counsel for the respondents submits that, it is 50% of Rs.18,00,000/-, which needs to be deposited by the appellant.
Since the assessment order itself is under challenge, the appellant is directed to deposit the 50% of Rs.18,00,000/- with the respondents, within a period of two months from today. In case the said amount is not deposited within the period of two months, the respondents shall be free to take the course of action against the appellant.
With these directions, the Writ Appeal stands disposed of.
