THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.14150 OF 2015 O R D E R :

This writ petition is filed for a Writ of Mandamus declaring the action of the Revenue Divisional Officer, Ongole, Prakasam District-3rd respondent in passing orders vide Rc.No.I/463/2015, dated 30.04.2015, suspending the authorisation of the petitioner's fair price shop No.48 of H.Nidamanur Village, Naguluppalapadu Mandal, Prakasam District, as illegal and arbitrary and consequently to set aside the same.

The case of the petitioner is that his fair price shop authorisation was suspended vide proceedings No.I/463/2015, dated 30.04.2015 by the 3rd respondent. Against the same the petitioner preferred an appeal along with stay petition before the 2nd respondent on 02.05.2015. But, the 2nd respondent has not passed any orders either in the stay petition or in the appeal. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that petitioner has not committed any violations and that since the petitioner earlier filed writ petitions against the respondent authorities, his fair price shop authorisation was suspended.

Heard learned Assistant Government Pleader for Civil Supplies. Since statutory appeal filed by the petitioner before the 2nd respondent is pending, the 2nd respondent is directed to dispose of the appeal within a period of six weeks from the date of receipt of a copy of this order. Till then, there shall be interim suspension of the impugned proceedings dated 30.04.2015.

However, petitioner shall cooperate with the respondent authorities in disposal of the appeal. If petitioner does not cooperate, it is for the 2nd respondent to pass orders in accordance with law.

With the above direction, writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
