HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45965 of 2016 ORDER:
The present writ petition is filed by the petitioner seeking to declare the action of the respondents in not considering and disposing of the representation, dated 02.12.2016, submitted by the petitioner for closure of rowdy sheet in terms of police standing order No.601, as arbitrary and illegal, and consequently, direct the respondents to consider and dispose of the representation submitted by the petitioner. Heard and perused the material available on record. The case of the petitioner is that a rowdy sheet was opened against the petitioner since he was involved in two crimes before the Gajuwaka Police Station, Visakhapantam, and that for the past six years, he has not been involved in any crime and he is not causing any breach of peace or disturbance to the public order and security.
The petitioner submitted a representation to the 2nd respondent on 02.12.2016, informing his non-involvement in any case and requested the 2nd respondent to close the rowdy sheet pending against him, but no action has been taken by the 2nd respondent on the representation made by the petitioner. Considering the circumstances of the case and also the grievance of the petitioner, the 2nd respondent is directed to consider the representation, dated 02.12.2016, made by the petitioner and pass appropriate orders in accordance with law.
Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J December 28, 2016.
