HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:35277 OF 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking a direction to consider the representation of the petitioner.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the daughter-in-law of the petitioner filed a divorce petition against her husband. Subsequently, some unknown persons were enquiring about the details of the family of the petitioner. Then, the husband of the petitioner made a complaint to take necessary action and to provide protection. The petitioner and her husband filed a suit against their daughter-in-law for perpetual injunction restraining her and her family members from interfering with their peaceful possession and enjoyment of their house. After filing of the said suit, her daughter-in-law filed a complaint against her family members for the offence under Sections 498-A, 307, 477, and 406 r/w 34 IPC. On 29.6.

2016, while the petitioner and her husband went to Women Development and Child Welfare office at Kadapa for counseling, the parents of their daughter-in-law and their henchmen tried to attack them, and they filed a false complaint against the petitioner in respect of the said attack. On 4.7.2016 and 11.7.2016, the petitioner and her husband made representations to provide protection. But the said representations were not considered. It is also the grievance of the petitioner that the official respondents are harassing the petitioners.

Considering the facts and circumstances of the case and the grievance of the petitioner, the Writ Petition is disposed of with the following direction:

"Respondents Nos.2 to 4 are directed not to harass the petitioner in the name of the investigation and they are directed to follow the procedure. Further, they are directed to dispose of the representations made by the petitioner and her husband, within a period of one month from the date of receipt of a copy of this order."

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
