THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.21891 of 2006 Order:

This Writ Petition is filed to declare the inaction of the respondents in providing safe passage and possession of the house No.231, Ground Floor, in Gauthamnagar Colony, as illegal.

According to the petitioner, he was a bonded labourer and he was issued D-Form patta; the possession certificate was also issued to him in respect of house No.231, Ground Floor, in Gauthamnagar colony; when he was not allowed to enter into the house allotted to him, he gave many representations, but the respondents did not take any action. Hence, he filed the present writ petition.

When the matter is taken up for hearing today, learned counsel for the petitioner submits that now there is a safe passage to the house of the petitioner and that he is in possession of the said house. However, he requests that the petitioner may be permitted to avail the alternative remedies available to him under law, in case if he is dispossessed from the house in future.

In view of the submission made by the learned counsel for the petitioner, no further orders are necessary in the present Writ Petition and the same is, accordingly, closed. However, liberty is given to the petitioner to avail the alternative remedies available to him under law, if he is so advised. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
