THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6746 of 2018 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. The case of the petitioner is that the land admeasuring Acs.11.13 guntas in Survey Nos.1155, 1156, 1159, 1160 and 1161 situated at Ramanujavaram Revenue Village, Manuguru Mandal, Bhadradri Kothagudem District, belongs to the petitioner. He applied for pattadar pass books and title deeds and for entering his name in the revenue records. When no action was taken on the said request, the petitioner approached the Joint Collector, who numbered the revision petition as R.P.No.28 of 2017. It was disposed of by order dated 07.11.2017 directing the Tahsildar, Manuguru, to enquire on the field and record in the possession column with regard to the person in possession and enjoyment of the land and submit a report.

Now the learned Counsel for the petitioner submits that the Tahsildar submitted a report to the Joint Collector on 04.12.2017 and in spite of the same, when the third respondent did not pass any further orders, the present Writ Petition is filed.

The order of the third respondent dated 07.11.2017 is not clear as it does not show remand or disposal of the matter by

final order. Since he directed the fifth respondent to submit a report, now the fifth respondent without mutating the names in the revenue records, submitted the report to the third respondent on 04.12.2017.

In such circumstances, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the third respondent to consider the report of the fifth respondent dated 04.12.2017 and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 28.02.2018 vs
