THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Appeal No.225 of 2010 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The relief sought for in the writ petition was to grant extra time to the petitioner to appear in the examination held pursuant to the notification dated 06.11.2009.

In the order under appeal the Learned Single Judge observed that, since examination was already conducted and the clause in the present form did not enable the other physically handicapped persons to avail the benefit of extra time in case they write the examination, in their own hand-writing, the appellant-writ petitioner could make a representation well in advance, if he takes the examination next time. The writ petition was disposed of leaving it open to the appellant -writ petitioner to claim the benefit of extra time in future NET examination by making application before hand and, if necessary, by approaching this Court well in advance.

While admitting the writ appeal on 31.05.2010, the Division Bench took note of the fact that, by proceedings dated 09.04.2010 the appellant-writ petitioner had already been provided a scribe and also extra time, and there was no necessity for granting interim directions. The W.A.M.P. was, accordingly, dismissed. As the examination held pursuant to the earlier notification was in the year 2010, and seven years have since elapsed, the cause in the writ appeal does not survive; and the writ appeal has become infructuous.

The Writ Appeal is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
