HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1115 OF 2016 ORDER:

This petition is filed by the petitioner - Accused No.2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.48/1/2/2015-NCB-Hyderabad Zone, registered for the offence punishable under Section 8 (c) r/w. 21 (c), 23, 27-A, 28 & 29 of NDPS Act.

Heard and perused the material available on record. The allegation against the petitioner is that he was found in possession of 1.056 kgs., of heroin.

Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and basing on the confessional statements of the other accused only, the petitioner was arrested and the investigation of the case was already completed and the charge sheet has also been filed and hence, he may be granted bail.

Filing of charge sheet is not a ground to grant bail to the petitioner. Since the quantity of the drug seized from the possession of the petitioner is more than commercial quantity, this Court is not inclined to grant bail to him.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J February 08, 2016.
