When the matter was called on 17.03.2017, there was no representation on behalf of the appellant and, hence, the matter was directed to be listed after two (2) weeks. Again, after two (2) weeks, when the matter was called, there was no representation on either side, the matter was directed to be listed after one week, under the caption 'for orders'. Even today, when the matter appeared in the list, under the caption 'for orders', there is no representation on either side. Under these circumstances, as the parties are not evincing any interest to pursue the matter, the appeal is dismissed for non-prosecution. In consequence, miscellaneous petitions, if any, pending in this appeal, shall stand dismissed as infructuous.
