Orvakal Police Station, Kurnool District, Rep.by its Public Prosecutor, High Court at Hyderabad For the State of Telangana & A.P. .....Respondent/Complainant Petition under Section 438 of Cr.P.C praying that in the circumstances stated in the memorandum of grounds filed herein the High Court may be pleased to enlarge the Petitioners on bail in the event of their arrest in connection with F.I.R.No.27 of 2018, dated 30.01.2018, on the file of the Orvakal Police Station, Kurnool District. The petition coming on for hearing, upon perusing the Petition and the memorandam of grounds filed in support thereof and upon hearing the arguments of Mr.K.S.Murthy, Advocate for the Petitioners and of the learned Public Prosecutor (AP) for Respondent. The Court made the following Order:
This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioners, who are A1 to A7, in Cr.No.27 of 2018 on the file of the Station House Officer, Orvakal Police Station, Kurnool District. The offences alleged are under Sections 147, 148, 452 307, 506, 427, 379 read with Section 149 of the Indian Penal Code. 2.
Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the respondent.

The case of the prosecution is that some women went and damaged the wine shop. The report shows that there was a demand for shifting of wine shop earlier.

The counsel for the petitioners submits that the petitioners are the ones who went to rescue the women, who were beaten up in the protest to shift the wine shop.

Hence, considering the above, this Court finds it a fit case to grant anticipatory bail to the petitioners.
Hence, the criminal petition is allowed. The petitioners are directed to surrender before the Station House Officer, Orvakal Police Station, Kurnool District within days from the date of this order.
On such surrender, the petitioners shall be released on bail on their executing personal bonds for a sum of Rs.10,000/ - (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners shall abide by the conditions mentioned under Section 438(2) Criminal Procedure Code, as under:
1. The petitioners shall make themselves available for interrogation by a police officer as and when required.
2. The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
3. The petitioners shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
