THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6444 of 2015 ORDER:

The petitioner was appointed as a Conductor on contract basis on 11.07.2008 after undergoing the process of regular selection. While he was performing his duty in the Ranigunj-I Bus Depot, Hyderabad, his services were terminated by proceedings of respondent No.4 dated 09.02.2009 on the allegation that he absented for duties from 02.01.2009 to 09.02.2009. Against the said order, the petitioner preferred an appeal on 09.02.2010 before respondent No.3 and the same was allowed in part by proceedings dated 25.03.2010 directing his reinstatement as a fresh conductor on contract basis. He was reinstated into service and posted at Cantonment Bus Depot, but due to bad health of his father and his subsequent death on 20.03.2010 he failed to report for duty.

After completing the death ceremonies, when he approached the Depot Manager, Cantonment by submitting the joining report, he was not permitted to join the duty. He approached respondent No.3 requesting for extension of time for reporting the duty, but respondent No.3 did not consider the same. Against the said action of respondent No.3, the petitioner submitted a review petition before the Regional Manager on 31.10.2014 and when the same was not disposed of, the present writ petition was filed. Though the writ petition is pending since March 2015, no counter affidavit is filed by the respondents. In the circumstances, this Court is constrained to dispose of the writ petition with a direction to respondent No.2 to consider the review petition filed by the petitioner on 31.10.

from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
