THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1142 of 2016 ORDER:
This Contempt Case was filed alleging willful disobedience to the order dated 13.11.2015 passed by this Court in Writ Petition No.36898 of 2015. By the said order, this Court directed the police authorities to take necessary action upon the petitioner's complaint dated 26.10.2015 in the light of the law laid down by the Supreme Court in LALITA KUMARI v. GOVERNMENT OF UTTAR PRADESH[1].
The Sub-Inspector of Police, Huzurnagar Police Station, Nalgonda District, filed a counter-affidavit stating that upon a preliminary enquiry on the petitioner's complaint, it was revealed that civil litigation was pending in relation to the subject land and it was intimated to the petitioner that no action was warranted under criminal law vide notice, dated 14.07.2016. A copy of the said notice is also placed on record.
In that view of the matter, this Court finds no disobedience, much less willful disobedience, to the order passed by this Court warranting exercise of contempt jurisdiction.
The Contempt Case is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
