Learned counsel for petitioner does not press the writ prayer and seeks liberty to file appeal against the seizure of borewell in the subject matter of the writ petition.

The petitioner is given liberty to file appeal along with a copy of this order within eight weeks from the date of receipt of a copy of this order. If the appeal is filed, as permitted by this Court, the appellate authority is directed to examine the merits of the case, hear both the parties and pass orders in accordance with law. The writ petition is disposed of accordingly. No order as to costs.
